Terms

Terms and Conditions

These Terms and Conditions apply to forms, registrations, applications, deposits, and payments submitted through V3 Preparatory Academy Ltd., V3 Prep Basketball Academy, and related V3 basketball programs (collectively, “V3”).

Nothing in these Terms and Conditions is intended to limit any rights or remedies available under applicable law. Any refund required by applicable law will be provided.

1. General Applicant and Participant Confirmation

By submitting any form, registration, application, or payment through V3, the applicant, participant, student, and/or parent or guardian confirms that the information provided is accurate, complete, and honest to the best of their knowledge.

V3 may rely on the information submitted for admissions review, team placement, event registration, travel planning, safety, communication, and administrative purposes. If any material information changes, the applicant, participant, student, and/or parent or guardian must notify V3 promptly.

2. Applications and Evaluation Services

This section applies to school applications, player evaluations, profile reviews, admissions assessments, and identification sessions where V3 provides an evaluation, review, or assessment service.

Application review fees, player evaluation fees, profile review fees, and ID session fees are non-refundable once the related review, evaluation, or session has been provided, except where a refund is required by applicable law.

Where V3 expressly states on a form, invoice, or offer that an application or evaluation amount will be credited toward a future program or enrollment, that credit will be applied only as stated in the applicable offer or registration terms.

Submitting an application, attending an ID session, or participating in an evaluation does not guarantee admission, team placement, scholarship, playing time, roster status, or any recruiting outcome.

3. Open House and Information Sessions

This section applies to free or paid open houses, information sessions, school tours, and similar introductory events.

Submitting an open house or information session form does not create any enrollment, tuition, or payment obligation unless the form or event page clearly states otherwise.

If an open house or information session is free of charge, no tuition, deposit, or program payment obligation arises from attendance alone. Any future application, registration, deposit, or enrollment will be governed by the separate terms provided for that service or program.

If an open house or information session includes optional physical activity, on-court participation, or athletic demonstrations, participants must follow all staff instructions and participate only if medically fit to do so.

4. Camps, Clinics, and ID Sessions

This section applies to camps, clinics, showcases, combines, tryouts, and basketball ID sessions offered by V3.

Registration fees for camps, clinics, and ID sessions are subject to the event-specific terms disclosed on the applicable registration page, flyer, invoice, or checkout form. If no different event-specific terms are posted, fees become non-refundable once the participant’s place has been reserved and the event is scheduled, except where a refund is required by applicable law.

If a participant cannot attend because of a documented medical reason reported before the event, V3 may, in its discretion, issue a credit or partial refund after deducting any non-recoverable third-party or administrative costs already incurred, unless a greater refund is required by applicable law.

If V3 cancels an event or cannot deliver a material part of the event, V3 will provide an appropriate refund, credit, or rescheduling option, subject to any non-recoverable third-party costs where permitted by law.

5. AAU and Non-Scholastic Programs

This section applies to AAU teams, club teams, non-scholastic teams, and related travel or competition programs.

Deposits, commitment fees, or roster-holding fees for AAU or non-scholastic programs may be designated as non-refundable once the player’s roster position is confirmed, uniforms or gear are ordered, league or tournament entries are paid, or other team commitments are made, provided those terms are clearly disclosed on the applicable registration or payment page.

Program fees for AAU and non-scholastic participation are governed by the terms disclosed for the specific team or program. Those terms may include payment schedules, date-based withdrawal rules, non-refundable deposits, and limited credits for documented medical withdrawals, subject to applicable law.

If a player cannot attend a scheduled travel event for a documented medical reason, V3 may review the amount actually spent or committed for that event and may hold any unspent balance as a credit for future approved use, if any amount remains after deducting non-recoverable third-party costs.

6. Scholastic Enrollment and Tuition

This section applies to scholastic students enrolled or seeking enrollment in V3 Preparatory Academy, including academic, athletic, housing, meal, and travel components of the school-year program.

Tuition, deposits, academic course fees, residence fees, meal plan fees, and travel-related charges for scholastic students are governed by the student’s signed enrollment agreement.

Where the enrollment agreement identifies specific payment schedules, non-refundable components, online academic course access fees, confirmation deposits, withdrawal provisions, or date-based refund schedules, those terms apply to the extent set out in the signed enrollment agreement, subject to applicable law.

Submitting an inquiry, application, or preliminary payment does not by itself create a scholastic enrollment contract unless and until the School issues and the parties sign the applicable enrollment agreement.

7. Deposits and Online Payments

This section applies to deposit pages, “make a payment” pages, invoice payments, and other online payment pages operated by V3.

A payment made through a V3 payment page is applied only to the program, event, team, or enrollment identified on that page or on the related invoice or agreement.

A deposit is non-refundable only where the applicable payment page, invoice, registration form, or agreement clearly states that the deposit is non-refundable and identifies the service or program to which it applies.

Where a payment page is used only as a payment collection mechanism, the refund, withdrawal, and cancellation rules for that payment are determined by the registration form, event terms, invoice, or enrollment agreement associated with that payment.

Processing fees charged by payment processors or financial institutions are non-refundable unless otherwise required by applicable law or unless V3 agrees otherwise in writing.

8. Misrepresentation and Administrative Action

If any information provided by an applicant, participant, student, or family is materially false, incomplete, or misleading, V3 may refuse admission, revoke an offer, remove a participant from a program, or terminate participation or enrollment in accordance with the applicable form, policy, or agreement and subject to applicable law.

Any refund consequences arising from such action will be determined under the event terms, program terms, invoice, or enrollment agreement that applies to the relevant service, subject to applicable law.

9. No Guarantee of Outcome

Unless expressly stated in a signed written agreement, V3 does not guarantee admission, roster placement, team selection, playing time, scholarship awards, recruiting exposure, university or college acceptance, athletic placement, or professional opportunities.

Any statements made by V3 about development, exposure, support, academics, or progression are descriptions of the program and its intended benefits, not guarantees of any specific result.

10. Assumption of Risk and Athletic Participation

Participation in basketball, training, strength and conditioning, clinics, camps, games, travel, open gym sessions, demonstrations, and related athletic activities involves inherent risks, including the risk of serious injury.

By registering for or participating in these activities, the participant and/or parent or guardian acknowledges those inherent risks and agrees that participation is voluntary. The participant and/or parent or guardian also confirms that the participant is medically fit to participate or has obtained appropriate medical clearance.

To the fullest extent permitted by applicable law, the participant and/or parent or guardian accepts the ordinary risks of participation and releases V3, its directors, officers, employees, coaches, contractors, and volunteers from claims arising from those ordinary risks, except to the extent caused by negligence, wilful misconduct, or any liability that cannot lawfully be excluded.

The participant and/or parent or guardian agrees to follow all safety instructions, posted rules, codes of conduct, and directions from V3 staff and coaches.

11. Medical Authorization

Where immediate action is reasonably necessary and a parent or guardian cannot be reached in time, the participant and/or parent or guardian authorizes V3 to obtain emergency medical assistance for the participant.

The participant and/or parent or guardian is responsible for maintaining valid medical and health insurance coverage and for all costs not covered by insurance, unless otherwise stated in a written agreement.

12. Photos, Video, and Promotional Use

Unless a participant, student, or parent or guardian provides written notice opting out, V3 may use photographs or video recordings that include the participant or student for reasonable educational, promotional, recruiting, team, and program-related purposes, provided the materials are used lawfully and in a manner consistent with V3 policy.

V3 will not knowingly make any false, misleading, or deceptive statement about a participant’s age, achievements, ranking, scholarship status, or recruiting status.

13. Privacy and Communications

By submitting a form or registration, the participant, student, applicant, and/or parent or guardian consents to V3 using the contact information provided to communicate about the relevant application, registration, event, payment, team, or program.

V3 may also send information about related programs, upcoming events, follow-up opportunities, or administrative matters, subject to applicable privacy and electronic communication laws.

14. Governing Law and Interpretation

These Terms and Conditions are governed by the laws of the Province of Ontario and the laws of Canada applicable in Ontario.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Where a separate written agreement, invoice, registration page, or enrollment agreement applies to a specific service or program, that more specific document will govern to the extent of any inconsistency.
